Under the Civil and Commercial Code (Family Book), a child born to unmarried parents is the legitimate child of the
mother; parental authority stays with her until the father legitimates the child under law.

1. Legal status: why legitimation comes before enforceable child support
Family-law support duties attach to being a legal parent.
Without legitimation, the man may not yet be a “legal father,” even if the child calls him dad.
In practice there are two paths:
- He cooperates: register legitimation at the amphoe/district office (a minor mother must consent under the registrar’s rules).
- He refuses: sue for legitimation in the Juvenile and Family Court and request child-support orders in the same case.
The court may order genetic (DNA) testing if paternity is disputed.
Early evidence helps: birth certificates, chats admitting paternity, family photos, past transfers for the child, and his address/workplace.
Correct meaning: parental authority stays with the mother until legitimation.
After legitimation, the father has a support duty, and the court may set custody or visitation in the child’s best interests.

2. Steps with the Office of Rights Protection and Legal Aid (OCS)
The
Office of Rights Protection and Legal Aid to the People (OCS)
under the Office of the Attorney General operates provincial offices.
Services include advice, mediation, and legal assistance under published criteria — especially for low-income people.
1Prepare documents
National ID, house registration, children’s birth certificates, income proof (payslip / income certificate), evidence he is the father, and his address/workplace.
2Go to provincial OCS
Ask at the provincial court or prosecutor’s office where OCS sits. You do not pay a private lawyer at this counter just to start a consultation.
3Mediate before filing
Staff may call the father in to discuss legitimation and support. A settlement saves time.
4If mediation fails
The office assesses whether it can help file under low-income criteria — help through to judgment is not guaranteed for every case.

3. How courts set support amounts and how enforcement works
There is no fixed “baht per child” tariff.
Courts weigh the child’s needs (food, housing, school, healthcare) against the payer’s means.
A mother’s 5,000 baht monthly income is important evidence of need —
but the ordered amount also depends on the father’s income and obligations.
- Do not assume multi-year “back support” will always be awarded in full — the claimable period depends on pleadings, facts, and discretion. Have legal-aid staff draft the request.
- After judgment, if he does not pay, pursue enforcement via the
Legal Execution Department
(wage/account garnishment or asset attachment) when income or assets can be found. - If he has no job and no assets, real collection may be limited even after you win.
